Transport Team
This Privacy Notice is designed to help you understand how and why the Transport Team processes your personal data. This notice should be read in conjunction with the Council’s Corporate Privacy Notice.
Who are we?
Redcar and Cleveland Borough Council is a ‘Data Controller’ as defined by Article 4(7) of the UK General Data Protection Regulation (UK GDPR). The Transport Team process data for the purposes of facilitating the Council’s Home to School Transport Service and transport for adults.
What personal information do we collect?
To assess eligibility for transport support, we collect the following personal information:
- Your personal details, such as your name, address and contact information.
- Your child’s personal details, including their name, address, date of birth and any photograph provided with the application.
- Special category data, such as Education, Health and Care Plans, details of special educational needs, and health information about any needs we must consider when providing transport.
- Financial information, for example where we pay a personal travel budget or need to assess low-income eligibility.
Why do we collect your personal information?
We use personal data to:
- Assess applications and appeals for home to school transport.
- Administer and oversee the home to school transport service.
- Assess and manage transport provision for adults.
- Process payments for transport services.
Who do we obtain your information from?
We will usually collect your or your child’s information from you when you make a transport application. We may also obtain information from your or your child’s social worker if they are helping with the application, the Council’s SEND service to confirm EHCP status and details of any special educational needs, and your child’s school.
Who do we share this information with?
We may share your personal information with relevant partner organisations where necessary, including but not limited to:
- Council teams working to improve outcomes for children and young people
- Transport teams within the Council
- Council officers involved in the appeals process, including Legal Services
- Council teams involved in your care, such as Social Care
- Commissioned transport providers for you or your child
- Schools and academies
- MTC who our school transport system provider
How long do we keep your information for?
If you/your child do not receive transport assistance, we will hold your data on council systems for up to 1 year after the date of refusal.
If you/your child receives transport assistance, we will hold your data for 6 years after the transportation ceases.
What is our lawful basis for processing your information?
We collect and use your personal data to carry out tasks in the public interest. We rely on the following legal bases under UK GDPR:
- Article 6(1)(e) Public Task: the processing is necessary to perform a task in the public interest or for official functions (task or function has a clear basis in law).
When we collect or share special category personal data, we rely upon the following legal bases under UK GDPR:
- Article 9(2)(g) Reasons of substantial public interest. We rely on ‘equality of opportunity or treatment’ purpose condition from Schedule 1 of the Data Protection Act 2018.
Your Rights
You have a number of rights that you may exercise in relation to your personal data. Some of the rights do not apply automatically and may not be available in certain circumstances where a lawful exception applies.
- You have a right to access your personal data. You can request a copy of personal data that we hold about you and ask us to explain how we use your data.
- You have a right to object to processing of your personal data. You have an absolute right to stop your data being used for direct marketing. In other cases where the right to object applies, we may be able to continue using your data if we have a compelling reason for doing so.
If we are relying on consent as the lawful basis to process your data you can withdraw your consent at any time, and we will stop further processing.
- You have a right to request the restriction or suppression of your personal data.
- You have a right to have your personal data erased, if we no longer have a legitimate use for it. This right is sometimes called the ‘right to be forgotten’.
- You have a right to rectification of your personal data if the information we hold in relation to you is inaccurate or incomplete.
- You have a right not to be subject to any decision based solely on automated processing, including profiling, which produces legal or similarly significant effects. You can request human intervention or challenge any solely automated decision-making that significantly affects you.
