Development management

This Privacy Notice is designed to help you understand how and why the Development Management team processes your personal data. This notice should be read in conjunction with the Council’s Corporate Privacy Notice.

Who are we? 

Redcar and Cleveland Borough Council is a ‘Data Controller’ as defined by Article 4(7) of the UK General Data Protection Regulation (UK GDPR). The Development Management Team oversees the administration and processing of a wide range of planning applications and pre-application submissions to the Council. It also manages related functions, including enforcement, monitoring and fulfilling statutory consultation responsibilities. 

What personal information do we collect?

  • Basic details about you, for example name, postal address, email address, and phone number
  • Payment details (we do not store this information)
  • Personal & professional opinions
  • Details of agents where applicable
  • Contact we have had with you, for example, appointments & letters of correspondence
  • Notes and reports about your relevant circumstances
  • Details and records about the service you have received.

We do not routinely collect information categorised as sensitive, however we may be supplied with information as part of an application or subsequent consultation. Where we are supplied with this information it will be processed only to carry out our legal obligations and in line with data protection policies.

Why do we collect your personal information? 

The Council, as the local planning authority, has a duty to consider applications for development in the public interest. We process information provided as part of an application including application forms, plans, documents and other supporting information. We invite statutory consultees, local people and organisations to comment on planning applications. 

We collect your personal information in order to carry out our planning activities and to provide our services, including:

  • Processing and determining planning applications
  • Providing you with advice and information 
  • Considering comments in relation to an application
  • Taking payment for the processing of an application
  • Enforcing planning conditions and obligations and taking enforcement action.

If you fail to provide certain information when requested, we may be unable to process your planning application, comments submitted in association with an application or investigate any alleged breaches of planning. 

Who do we obtain your information from?

We collect your personal information directly from you by letter, email, telephone, online and through face-to-face contact, or from a representative that you have appointed.

Who do we share this information with?

Planning application details will be made available on our online public register, and this will include the name and address of the applicant as well as the details of the agent where applicable. 

We are required to undertake consultations with internal departments and external organisations and neighbours, to obtain their views on planning applications and pre application advice. This involves sharing your submission details. 

We are required to make representations on planning applications available for public inspection under the Local Government (Access to Information) Act 1985. Before publishing online, we will remove (redact) email addresses and telephone numbers, however, your name and postal address will remain visible. 

How long do we keep your information for?

We will not keep your information longer that it is needed or the law says we can. Information is kept in line with the Council’s retention policy and schedule. 

What is our lawful basis for processing your information?

Redcar and Cleveland Borough Council relies on the following lawful basis to process your personal data:

  • UK GDPR Article 6 (1)(c) – processing is necessary for compliance with a legal obligation to which the controller is subject e.g. determining a planning application under the Planning Act 2008. 
  • UK GDPR Article 6 (1)(e) - processing is necessary for the performance of a task carried out in the public interest e.g. when considering enforcement action under the Town and Country Planning Act 1990, where there is a public interest in enforcing planning law and regulation. 

Your Rights

You have a number of rights that you may exercise in relation to your personal data. Some of the rights do not apply automatically and may not be available in certain circumstances where a lawful exception applies. 

  • You have a right to access your personal data. You can request a copy of personal data that we hold about you and ask us to explain how we use your data. 
  • You have a right to object to processing of your personal data. You have an absolute right to stop your data being used for direct marketing. In other cases where the right to object applies, we may be able to continue using your data if we have a compelling reason for doing so. 

If we are relying on consent as the lawful basis to process your data you can withdraw your consent at any time, and we will stop further processing. 

  • You have a right to request the restriction or suppression of your personal data. 
  • You have a right to have your personal data erased, if we no longer have a legitimate use for it. This right is sometimes called the ‘right to be forgotten’. 
  • You have a right to rectification of your personal data if the information we hold in relation to you is inaccurate or incomplete. 
  • You have a right not to be subject to any decision based solely on automated processing, including profiling, which produces legal or similarly significant effects. You can request human intervention or challenge any solely automated decision-making that significantly affects you.
