Control of occasional sales
“Occasional sale” means an event at which articles are offered for sale to the public by one or more sellers in the course of a trade or business.
The following is not an occasional sale:
- A market established by statute
- A market wholly or mainly for the sale by auction of farm livestock or deadstock or the contents of a building
- An event promoted or conducted by a charity registered under section 4 of the Charities Act 1960
A person who holds an occasional sale includes any person who:
- charges admission to the premises used for the sale, or
- is entitled as the promoter to payment in respect of goods sold to persons attending the sale.
Notice of the occasional sale
If you intend to hold a sale or permit a sale to be held on your premises, you should give notice of that sale to the council not less than 21 days before the sale.
The notice must be in writing and should specify the following:
- The name and business address of the promoter of the sale
- The premises where the sale will be held
- The date and times sale will take place
- The nature of the goods or services to be provided
- The number of persons expected to attend the sale
