A Trading Standards investigation into the sale of illegal cigarettes, tobacco and vapes has led to two businesses being closed down.
A Closure Order was issued by magistrates on Thursday, 11 January 2024, against a Redcar shop after suspected illegal cigarettes and tobacco products were found at the premises.
Trading Standards, accompanied by a tobacco detection dog and handler and Cleveland Police officers, carried out an inspection at 170 High Street, Redcar, in December 2023 after receiving reports that a business, which had recently opened, was selling illegal cigarettes.
A District Judge at Teesside Magistrates Court was informed that the premises had no signage providing a business name and that the windows had been covered in paint to obscure the view from the street. A quantity of cigarettes and hand rolling tobacco products which were suspected to be counterfeit or otherwise illicit in nature was seized from the premises.
The hearing was told that the individuals running the unnamed business had previously been involved in operating two other shops in Redcar, Redcar Mini Market and Ocean Continental Food Store, which had both previously been subject to Closure Orders in 2022 and 2023 for the sale of illegal tobacco.
The second application for a closure order against LA European Mini Market trading from 15 Ennis Square, Dormanstown, Redcar, TS10 5JZ, was granted by magistrates on the same day for a period of three months. The shop has been shut down following sales of illegal vapes and cigarettes.
Magistrates heard that after receiving a complaint about the sale of a vape to an underage person, the business received advice on the sale of age-restricted products from Redcar & Cleveland Trading Standards in July 2023. Despite this advice, further complaints were received by Trading Standards about underage sales, along with reports that the shop was selling illicit tobacco and non-compliant vapes.
A subsequent inspection of the shop by Trading Standards found a quantity of illegal vapes. The vapes were not compliant with the Tobacco and Related Products Regulations 2016 and were seized. The company and its directors were provided with formal written warnings in November 2023. Further advice on the sale of age-restricted products and nicotine inhaling devices was provided to the business.
A second inspection was carried out in December 2023 with a tobacco detection dog and handler after Trading Standards continued to receive complaints about the business.
During the inspection, tobacco products and vapes were recovered from an individual who was attempting to exit the rear of the property with the products in a food delivery bag and a carrier bag. The vapes were found to be illegal and the tobacco products did not comply with The Standardised Packaging of Tobacco Products Regulations 2015.
Cabinet Member for Health, Welfare and Housing Cllr Ursula Earl said: “Seeing such criminal activities taking place in our area is dreadful and the work done by our officers to ensure these premises are shut down is imperative for the safety of our communities and to protect businesses trading in accordance with the law. I would like to thank our Trading Standards Officers and Cleveland Police for the continuous efforts they put into bringing unlawful businesses to justice.”
Redcar Neighbourhoods Chief Inspector Jon Hagen added: “Businesses selling counterfeit or illicit products harm not only our local communities but also legitimate businesses. Fake products will almost certainly not have been subject to the usual testing and legislation and are a serious risk in themselves. I would warn anyone who believes they can persistently sell fake or illegal products that police will continue to work with local authorities to clamp down on these businesses and to deal with those running them.”
