What is Commercial / Trade Waste?
Any waste that comes from a commercial activity is business waste. If you use part of your home to run your business then any waste from that part is business waste, e.g. businesses, schools, charities, events, holiday homes, home businesses, and any other commercial activity.
All commercial businesses have a legal duty of care to responsibly dispose of their waste by a registered waste collector.
As a commercial waste producer, you must:
- keep waste to a minimum by doing everything you reasonably can to prevent, reuse, recycle or recover waste (in that order) - get help to do this
- sort and store waste safely and securely
- complete a waste transfer note for each load of waste that leaves your premises
- check if your waste carrier is registered to dispose of waste
- not allow the waste carrier to dispose of your waste illegally (and report them to Crimestoppers if they do)
- recycle waste that’s like household waste, including food and dry recyclables such as glass, plastic, metal, paper and card - there’s more information in the Simpler recycling: workplace recycling in England guidance.

Simpler Recycling
The law has changed in England which requires businesses to recycle a core set of recyclable materials.
If you have 10 or more full-time equivalent (FTE) employees you had to be compliant with the new legislation by 31st March 2025.
If you have fewer than 10 FTE employees in total across all of your premises, you must be compliant with the new legislation by 31st March 2027.
The new legislation in England requires the following types of waste to be separated:
- Food waste
- Dry mixed recycling
- General/residual waste
