Privacy Notice for Taxi & Private Hire Licensing

In order to provide the licensing service, it is necessary for us to collect personal information about you.  The information that is collected will depend on the type of licence and the nature of the activity.  Examples of licensing activities are:-

  • ​​Processing applications
  • Inspecting premises and vehicles
  • Investigating complaints

As well as your name, address and other contact details, this information may include the details of your premises and vehicle as well as details of contact that we have had with you such as any correspondence.


What is the legal basis for us to process your data?

All personal data held, is processed in accordance with data protection law. The Data Controller for the information outlined in this notice is Redcar & Cleveland Borough Council.

The lawful basis for processing the data is that it is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller - that is, assessing whether an individual is a fit and proper person to hold a hackney carriage or private hire licence and any vehicle is safe and suitable to be licensed.

The principal legislation under which functions are undertaken is contained in:

  • Town Police Clauses Act 1847
  • Local Government (Miscellaneous Provisions) Act 1976
  • Road Traffic Act 1988
  • Transport Act 1985


How will we use the information we hold about you?

​The Council has contracts with a number of third party service providers that support the day-to-day operation of our licensing services.  The Council also shares personal information with a number of other organisations as part of the licensing process. Such organisations may include the police, DVLA, Home Office, DWP, MIB, and other local authorities.

The Council is required by law to disclose information about licensed drivers to the Cabinet Office as part of the National Fraud Initiative.

The Council provides information to the National Register of Taxi Licence Refusals and Revocations.  This information is restricted to individuals who have had a hackney carriage or a private hire driver licence revoked or an application for one refused.

Licensee information may be made available to the public where relevant legislation requires or permits it or publication is in the public interest.  Examples include licensee names and associated badge or licence numbers, together with the status and expiry dates of those licences.

In some circumstances, disclosures of personal data to the police (and other law enforcement agencies) are permitted by data protection legislation if they relate to the prevention or detection of crime and/or the apprehension or prosecution of offenders.  Before any such disclosure takes place, the police are required to demonstrate that the personal data concerned is necessary for them to carry out a proper investigation.  Each police request received by us is dealt with on a strictly case-by-case basis to ensure that any such disclosure is lawful and carried out in accordance with relevant guidance issued by the Information Commissioner's Office.

We will not normally share your information with organisations other than our partner organisations without your consent; however, there may be certain circumstances where we would share without consent such as where we are required to do so by law, to safeguard public safety, and in risk of harm or emergency situations.  Any information which is shared will only be shared on a need to know basis, with appropriate individuals. Only the minimum information for the purpose will be shared.

 

How long do we keep your records?

We will only keep your information for the minimum period necessary.  We retain your personal information for a period of six years after the case has been closed.  This allows us to refer back to previous cases when considering any future applications.

Information entered on the National Register of Taxi Licence Refusals and Revocations will be retained for a period of 25 years.

We take the privacy of our licensees very seriously. We have a range of robust policies, processes and technical measures in place to control and safeguard access to, and use of, personal information associated with taxi and private hire licensing.

If you would like to receive copies of the personal data the Council holds about you in connection with licensing services, please email your request to the team at LicensingAdmin@redcar-cleveland.gov.uk.
