Private Water Supplies
Private water supplies (PWS) are drawn from a variety of sources, including wells, springs, boreholes, surface water and streams. There are 41 PWS within the Borough of Redcar & Cleveland.
In accordance with section 77 of the Water Industry Act 1991 (the Act), the local authority has a duty to take all such steps as they consider appropriate for keeping themselves informed about the wholesomeness and sufficiency of water supplies provided to premises in their area, including every private supply to any such premises.
The local authority must therefore monitor all PWS in accordance with the Private Water Supply (England) Regulations 2016 when carry out their duties under the Act.
The local authority has a duty to carry out a risk assessment for every private water supply in its area and review and update that risk assessment every 5 years (or earlier if it considers that the existing risk assessment is inadequate).
In the case of a supply provided to a single dwelling, the duty applies only where that supply is provided as part of a commercial or public activity. In the case of any other supply provided to a single dwelling, a local authority must carry out a risk assessment if requested to do so by the owner or occupier of that dwelling. The risk assessment must establish whether there is a risk of supplying water that would constitute a potential danger to human health
PWS must be sampled and analysed in accordance with the parameters detailed in the schedules of the Regulations.
If the local authority considers that a PWS is a potential danger to human health, it must promptly take appropriate steps to ensure that people likely to consume water from it are informed that the supply constitutes a potential danger to human health, where possible, are informed of the nature of the potential danger, and are given advice to allow them to minimise any potential danger.
