Construction Sites and Prior Consents

Construction sites are by nature noisy and the main control of noise from these sites is through restricting the hours that noisy work can take place.

As a general rule where residential occupiers are concerned we expect that the following working hours to be adopted for construction sites:
  • 7:30 or 8:00 am to 18:00pm Monday to Friday
  • 7:30 or 8:00 am to 13:00pm on Saturday
  • No working on Sundays or Public Holidays.
Developments may be restricted by conditions on their planning permission and you should in the first instance contact the Planning Department.

In some circumstances it may be necessary for noisy construction works to be carried out outside these hours. In such cases we expect the contractor to use advance publicity to warn residents and to outline their plans to minimise any disturbance.

Contractors should also do everything reasonably possible (using best practical means) to ensure noise from works is kept to a minimum at any time. This includes using well-maintained and silenced plant and equipment including compressors, generators and power tools.

Alternatively, contractors can make an application for prior approval under Section 61 of the Control of Pollution Act 1974 to carry out noisy construction work. Conditions such as hours of operation, plant and equipment used, methods of work and noise limits, may then be attached to a prior content.

Section 61 of the Act allows anyone who intends to carry out construction works to apply in advance for consent as to the methods by which the work is to be carried out.

Local authorities have powers to control noise (and vibration) from building sites under section 60 of the Control of Pollution Act 1974. where they consider that noise from construction is, or is likely to, constitute a statutory nuisance. The control is by the service of a notice on the person responsible for the construction operations to ensure that all noise is keep to a minimum.
