The Local Authority has a duty to keep minutes of the proceedings at a meeting which in particular records the decisions made. (Note: if you are researching minutes, always look at the next following meeting which will indicate if the minutes have been altered or approved by the committee members as a true record of the meeting.)

Borough Council Decisions

Ordinary meetings of the Borough Council will take place in accordance with a programme decided at the Councils annual meeting in May. Decisions reserved for the Borough Council are those which relate to the Council's budget and policy framework.

Cabinet Member Decisions

Executive Decisions can be taken by the Cabinet and each of the Cabinet Members, as well as some Council Officers, under delegated powers.

When can a decision be delegated?
The Scheme of Delegation, which is incorporated within the Council's Constitution describes which decisions must be taken by the whole Cabinet, which can be taken by individual Cabinet Members and which can be delegated to Officers. The Cabinet can delegate decisions to Chief Officers.

The decisions will be published within two working days. The decisions are communicated in a variety of ways:
  • in hard copy at Redcar and Cleveland House reception
  • electronically and/or in hard copy to all Members
  • published electronically on this website.

The publication notice will specify when the decision will come into force, and may then be implemented on the expiry of five working days after the publication of the decision, unless the decision has been called in for further scrutiny.

What decisions are due to be taken?
The Forward Plan details the key decisions to be taken by the Cabinet and its Members in the next four months, including those that concern the policy framework and the budget. They are published monthly.

Meetings of the Cabinet usually take place every six weeks and the collective decisions taken are recorded in the minutes of those meetings.

What is Call-In?
Call-In is a means by which decisions of the Cabinet can be examined further, to ensure that they have been properly made.

Once the Cabinet makes a decision, the Scrutiny function will have 5 working days from the date the decision is published, to request that the decision be called in for greater scrutiny.

Call In may only be used where it is felt that a decision has not been made in accordance with the following principles:

  • Proportionality (ie: the decision must be proportionate to the desired outcome)
  • Due consultation and taking of professional advice from Officers.
  • Respect for human rights.
  • A presumption in favour of openness
  • Clear aims and desired outcomes
  • An explanation of the options considered and the reasons for the decision

The Executive Scrutiny Board will consider a decision which has been called in and if it is concerned about it, may refer it back to the decision maker or to full Council for reconsideration, setting out in writing, the nature of its concerns.

The decision maker will then reconsider the decision and make a final decision as to whether the decision should be amended or not.

Cabinet & Committee papers

No action may be taken to implement any decisions until the expiry of the call-in period. If the Executive Scrutiny Board supports the original decision, then the decision can be implemented without delay and the decision stands.
